A Successful State Attorney’s Office is not a Given Fact

The author highlights the importance of a stable institutional framework for the State Attorney’s Office of the Republic of Slovenia to achieve strong results in its future work. In 2024, the State Attorney’s Office achieved an almost 100% success rate in state liability cases. However, statistical data indicate a concerning trend of declining interest in employment at the State Attorney’s Office. The author partly attributes this to an inadequate systemic arrangement stemming from the State Attorney’s Office Act of 2017, which for years has created unacceptable disparities in working conditions among employees. The proposed solution lies in amending the State Attorney’s Office Act, a change also supported by the Ministry of Justice. The author concludes by emphasising that a successful State Attorney’s Office is not a given and that it is worth striving for its continued effective operation—not only because of its past achievements but, above all, because of the potential that a stable and professionally strong State Attorney’s Office holds as a foundation of the judiciary, the rule of law, and democratic mechanisms.
