New president of the Association of the Slovenian Jurists Societies is a pro- fessor at the University of Ljubljana Faculty of Law Miha Juhart, PhD. Vice-

-president remains the same as before, Franci Gerbec, as well as its Secretary General, Boštjan Koritnik. The new Treasurer instead of the late Vida Šibenik is Branka Neffat. The former President Lojze Ude, PhD, who lead the Associa- tion for 16 years, was declared Honourable President.

Amendments to the General Administrative Procedure Act (ZUP) also Required an Upgrade of the Successful Commentary

In 2020, the publishing house Uradni list Republike Slovenije together with the Faculty of Law of the University of Ljubljana published a commentary on the General Administrative Procedure Act (Zakon o splošnem upravnem postopku – ZUP), edited by Professor Polonca Kovač, PhD, and Erik Kerševan, PhD. The commentary, which was published in two volumes, was a great success among users, as top Slovenian experts participated in it, and with the adoption of the Act on Debureaucratisation (Zakon o debirokratizaciji – ZDeb), which also interfered with the field covered by ZUP a reason arose to upgrade the Com- mentary. In September 2022, both the publisher and the authors added a third volume to the set, in which the authors discuss the changes enacted by the legislature from the first edition to the end of June 2022, taking into account important case law adopted during that time. The third book of the commen- tary was presented to the public at a round table in mid-September.

Judicial Protection, Spatial Interventions and the Aarhus Convention

The article presents a doctoral thesis examining the impact and significance of Article 9 of the Aarhus Convention, despite its brevity, on the foundational principles of Slovenian constitutional jurisprudence. The author portrays the request for a special public role as a legal enhancement of the checks-and- balances system among different authorities, addressing dwindling civil so- ciety confidence that it alone (without the public) can ensure that "the state authority will be a good or sufficient guardian of the (healthy living) environ- ment and which emerges as a legal response to the ‘feeling’ of a democratic deficit”. This doctoral thesis marks the first comprehensive study of judicial protection against environmentally impactful decision-making in the spatial interventions, which – according to other decisions of the enforcement law – is characterised by a number of specifics.

Faculty of Alumni Club: A Fresh Momentum in 2023

In late March 2023, the University of Ljubljana Faculty of Law Alumni Club conducted its annual general assembly at the Faculty’s premises, utilising both in-person attendance and audio-video conferencing. The president of the as- sociation is academician Janez Kranjc. Goals and tasks of the association are building social links among graduates of the Faculty of Law of the University of Ljubljana among themselves and with the faculty and its teachers and col- leagues; professional and scientific cooperation of graduates of the Faculty of Law with the Faculty; care for the reputation of the legal profession and edu- cation provided by the Faculty of Law, strengthening social ties between the Faculty of Law and its graduates; promotion of legal knowledge in the social environment of the association; contributing to the support of the activities of the Faculty of Law and its students. The reports for 2022 and the work plan for 2023 were approved by the general assembly.

Konrad Plauštajner (1941–2022)

In September 2022, a prominent lawyer from Ljubljana Konrad Plauštajner, PhD left us far too soon and unexpectedly. He was not only a lawyer, but also a husband, father, lecturer, publicist, arbitrator, that is, a human being and a great expert. He was primarily involved in alternative dispute resolution, in- vestment disputes, construction contracts and FIDIC and he brought a wealth of knowledge, energy and dedication to all of his endeavours. In 2010, he also received a lifetime achievement award from the Association of Iurists’ Socie- ties of Slovenia, and from 2008 until his death, he was a member of the edito- rial board of Pravnik journal.

University of Ljubljana Faculty of Law 30th in the World

In the 2022 Moot Court competitions, the Faculty of Law at the University of Ljubljana achieved an exceptional ranking on the Nica.team performance scale: 1st in Slovenia, 13th in Europe, and an impressive 30th globally. This result marks a notable improvement from 2021 when our esteemed faculty secured the 43rd position worldwide, itself a testament to our excellence in these student- led competitions. Moot Court competitions serve as simulations of court and arbitration proceedings, with students stepping into the roles of dispute parties’ delegates. The competitions, typically conducted in English or French, require students to address timely legal and social issues across a broad spectrum of law fields. These include European Union law, international commercial law, hu- man rights law, criminal law, asylum law, and space law, among others.

The European Parliament at the Crossroads

In the spring of 2024, the European Parliament gears up for its tenth direct election since 1979, marking another crucial milestone in transnational de- mocracy following the Conference on the Future of Europe. Historically, EP elections have been marred by national fragmentation and perceived as "second-class” due to low voter turnout in many Member States, including Slovenia. Nonetheless, these elections are still a central act for ensuring the democratic legitimacy of the EU and shaping its political trajectory. This arti- cle is a report from the event, the topic of which were the current challenges of European parliamentary democracy, especially one year before the European elections, such as the renewal of EU electoral rules, the promotion of electoral participation, and the proposition for an independent EU ethics authority.

The Last Book of a Revised Comprehensive Commentary of the Special Part of the Criminal Code (KZ-1) Was Released

In Slovenian history, the Criminal Code (KZ-1) had not been scientifically commented on in depth within the ambit of a large-scale research project. To describe the situation as unsatisfactory with regard to legal culture would be an understatement. In 2015, such research was finally undertaken in Slovenia, culminating in March 2019 with the publication of the first scientific commen- tary on the special part of the Criminal Code. Authored by 47 contributors and assisted by 33 professionals, this commentary was released in three vol- umes. The project was led by editors-in-chief being Katja Filipčič and Damjan Korošec, both from the University of Ljubljana, Faculty of Law. More than 3,000 pages were written on 291 Criminal Code articles. Since the first edition, four amendments have been adopted, with interventions in sexual and com- mercial criminal law being among the most theoretically and practically de- manding. By March 2023, with contributions from additional experts, all three volumes of the revised commentary were published, extending to 4,238 pages.

Pravnik Journal – Then and Now

Pravnik magazine is the oldest Slovenian professional and scientific journal,
with its origins tracing back to 1862. It began with the publication of Slovenski
pravnik (Slovenian Jurist), initially published by J.R. Razlag, PhD). Slovenski
pravnik continued intermittently until 1888, when the society Pravnik (Jurist)
took over as the publisher. The Association of Law Societies of Slovenia revived
the journal after the interruption due to the World War II. From l January 1965,
it has been published as Pravnik – A Journal for Legal Theory and Practice. In
2016, the Faculty of Law of the University of Ljubljana became a co-publisher.
Since 2008, the journal’s editor-in-chief has been Professor Emeritus at the
University of Ljubljana Dragica Wedam Lukić, PhD. The journal is included
in several international bibliographic databases and receives co-funding by the
Public Agency for Scientific Research and Innovation of the Republic of Slovenia
(ARIS).

Electoral Assembly of the Association of Jurists’ Societies of Slovenia

On the last working day of November, the Electoral Assembly of the Association
of Jurists’ Societies of Slovenia (ZDPS) convened at the Faculty of Law,
University of Ljubljana. The Assembly commenced with an address by the incumbent
President of ZDPS, Miha Juhart, PhD, followed by the crucial task
of verifying the quorum. The Statute requires the presence of more than half
of the members for the quorum; with the ZDPS currently comprising 24 active
members—associations of jurists, both general and "specialised”. Out of
possible 24, 14 delegates were present, thereby establishing the quorum of the
Assembly. The elections were conducted successfully: Miha Juhart, PhD, was
re-elected as President, Branka Neffat was elected the new Vice-President,
Boštjan Koritnik continued as Secretary-General, Uroš Škufca was elected
the new Treasurer, and the Executive Board welcomed new members Velibor
Dujaković and Vesna Bergant Rakočević, PhD, joining the existing members
Bojana Kmetec Rošic, Petra Ferk, PhD, Ajas Midžan, Jernej Kuzmič and Aleksander
Cmok. The Supervisory Board remains unchanged.

Electoral Assembly of the Association of the Slovenian Commercial Law Societies

On 15 December 2024, after four years of operation, the mandate of the leadership
of the second of the two legal associations—i.e. Association of the Slovenian
Commercial Law (ZDGPS)—ended, and in early December, its election
assembly was held accordingly. At their own request, President Etelka Korpič
Horvat, PhD, and Vice Presidents Darja Senčur Peček, PhD, and Franci Gerbec
resigned, and the assembly elected new officials to these two positions. A
professor from the Faculty of Law of the University of Maribor Vesna Rijavec,
PhD, was elected President. The newly appointed Vice Presidents of ZGDPS
are Branka Neffat, Klemen Drnovšek, and Tomaž Keresteš, PhD. Maja Ekart
remains the General Secretary, and Boštjan Koritnik continues as Treasurer.
The Supervisory Board has undergone the most changes: instead of Marijan
Kocbek, PhD, Branka Štanc, and Domen Bizjak, the new supervisors are Darja
Senčur Peček, PhD, as President of the Board, with Maja Mihelič and Srečko
Berk serving as members.

Extremely Successful Panda’s Charity Auction—EUR 14,060 for Paediatric Clinic

The Ljubljana Law Students’ Association (Pravna Panda) celebrated its tenth
anniversary in mid-December 2024 with a celebration that centred around a
charitable cause, in addition to featuring a large cake. The event took place at
Ljubljana Castle, where, in collaboration with Litteralis, the Institute for Constitutional
Law and the Association for Sports Law, a charity auction was held.
This event was also broadcast live on Facebook, allowing for broader participation.
The funds raised during the auction were designated for the clinical department
for neonatology at the Paediatric Clinic in Ljubljana, which provides
care for youngest newborns, up to 30 days old. The Clinic’s management has
already earmarked the proceeds for the purchase of infusion pumps. These
pumps are crucial for the administration of medicines and therapies to the
children. The auction was a resounding success, with a total of EUR 14,060
collected. This amount will be more than enough to cover the cost of six new
infusion pumps.

Victims and Winners of the Swiss Franc Loan Saga

Two years ago, the Supreme Court of the Republic of Slovenia completely changed its position on loans denominated in Swiss francs—a total reversal of the case law that the court had unanimously upheld five years earlier. Although no significant changes have occurred in the intervening case law, doubts have meanwhile arisen regarding the impartiality of some judges. It emerged that one of them is a judge whose appearance of impartiality can legitimately be challenged. At first sight, it may seem odd that such a revelation can so se riously undermine public expectations of the judiciary and the authority of its decision-making, yet trust is an exceedingly fragile commodity. Above all, this episode compels us to re-examine the arguments for the previously de scribed—and, to the author, still incomprehensible—reversal of case law. The author is convinced that the case law as formulated by the Supreme Court of the Republic of Slovenia carries a price: not only in the form of uncertainty and the erosion in confidence in contract law or the principle of the rule of law— principally threatened by retroactive legal regulation—but also in the form of demonstrably higher credit costs for future borrowers.

The Significance of Volunteering in Sports Is Invaluable

The Faculty of Law and the Faculty of Sports of the University of Ljubljana, together with the company Litteralis, the Sports Law Society, the Olympic Committee of Slovenia, the Student Council of the Faculty of Law and the student association Pravna panda, organised a conference entitled From Law and Economy to Olympic Medals on 24 April 2025 at the Faculty of Law of the University of Ljubljana. The speakers were jurist and Olympian Miro Cerar Sr. and President of the Olympic Committee of Slovenia and former President of the Board of Directors of Gorenje Franjo Bobinac. They discussed the interrelationship between the economy and sport with moderator Kristijan Briški. They emphasized the key role of volunteering in sport, its significance for tourism and the wider economy, and the positive effects of promoting both the economy and the country through participation and success in international sporting competitions, as well as through hosting such events. All agreed that Slovenia excels on both fronts, that sport unites people and serves as a universal language, and that it teaches self-discipline and while strengthening physical and mental health. An Olympic gold medal from the 1964 Tokyo Games—won by Miro Cerar Sr. on the pommel horse and one of his two gold and three total Olympic medals—was also on display for attendees.

The Importance of Wholesalers for the Security of the Pharmaceutical Market. What Consequences can the Same and (Too) Low Wholesale Margin for 15 Years have for the Supply of Pharmaceuticals in Slovenia?

In November 2020, the European Commission presented its European Medicines Strategy, whose objectives include: (1) ensuring timely and equitable access for all EU patients to safe, effective and affordable medicines; (2) increasing security of supply and ensuring that medicines are available to patients wherever they live in the EU; while (3) ensuring an attractive, innovationfriendly and competitive environment for research, development and production of medicines. Medicine shortages are becoming a significant public health risk across Europe and beyond. Tackling these shortages demands measures to be taken at all levels to improve the supply of medicines. Among other actors, wholesalers constitute crucial, though overlooked, link. They—especially the ones with the so-called full-line of operations—can also be part of the solution in reducing the risk of disruptions in the supply of medicines due to their way of doing business. However, it is true that with the changed market structure and other factors, the issue of the continued economic motivation of wholesalers to work in the public interest is becoming increasingly important, which participation in the process of supplying medicines undoubtedly is. Given that wholesaler margins in Slovenia are among the lowest in Europe, the author believes that changes in this area are urgently needed. The existing method of determining the wholesale margin may also call into question the expediency of carrying out the activity of supplying medicines in Slovenia.
